Employer group slams landmark penalty rates deal
The companies have also faced a slew of lawsuits, ranging from personal injury suits to claims of wage theft.
The Labor Department has been investigating for years, looking into possible wrongdoing by company employees as well as employees’ actions during off hours and overtime. It has also found that some workers received bonuses despite taking illegal time off in a discriminatory manner, according to a government audit.
“I can’t help but think what we’ve done is the only thing we did,” said Rep. Pete Sessions (R-Texas), chairman of the House Committee on Education and the Workforce.
Many of those lawsuits, however, have been unsuccessful in court.
Labor Secretary Thomas Perez and some other members of Congress have urged the administration to take a different tack in its investigation and bring criminal charges against people who work for Walmart who take improper breaks during the time off.
“My goal from this administration is to see people who engage in this illegal act prosecuted to the full extent of the law,” Rep. Elijah E. Cummings (D-Md.) said in January.
There is no evidence that people have worked at Walmart illegally, according to a recent government audit. Walmart told lawmakers at the time that it took measures to identify workers with “work related impairment.”
Still, Perez said the Justice Department and the Occupational Safety and Health Administration are investigating and should launch criminal investigations at any point.
“I don’t even know what the status is on that,” the Labor Department head said at the time. “The problem has to stop. If it continues this way, then I don’t know how long there can be this type of illegal activity at Walmart.”

“It is outrageous that they’re working on any enforcement, whether it’s a criminal investigation or a civil action,” Sessions said. “It’s just a big waste of time.”
Walmart declined to comment on this piece but said that it “is cooperating with federal, state and local law enforcement investigations, and will cooperate with any and all investigations” into what may be illegal activities at the retailer.
